End User License Agreement
Terms and conditions for using our software and services
License Grant
Subject to the terms of this Agreement, PictusCode grants you a limited, non-exclusive, non-transferable license to use our software products and services for your personal or business purposes.
This license does not include the right to:
- Modify, adapt, or create derivative works
- Reverse engineer, decompile, or disassemble the software
- Remove or alter any proprietary notices or labels
- Sublicense, rent, lease, or transfer the software to third parties
Restrictions
You agree not to use our products or services to:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights of others
- Transmit malicious code or interfere with system integrity
- Engage in unauthorized access to systems or data
- Compete directly with PictusCode using our own products
Intellectual Property
All intellectual property rights in our software, including but not limited to copyrights, trademarks, patents, and trade secrets, remain the exclusive property of PictusCode.
You acknowledge that our software contains proprietary and confidential information protected by applicable intellectual property and other laws.
Product Purchase Terms
Clone Scripts & Ready Products
The following terms apply to our clone scripts (Service Rabbit, Ternmet, SellHub, etc.):
- Script License: Includes the source code only. Hosting and mobile app deployment are available as add-ons ($300 each).
- Payment Methods: Accepted via Wise, PayPal, or Bank Transfer.
- GST: 18% GST applicable for customers in India.
- Video Review: Customers are required to provide a video review after project completion.
- Warranty: 30-day bug fix warranty from the date of delivery.
- Refund Policy: All sales are final and non-refundable once work has commenced.
Warranty Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
PictusCode does not warrant that the software will be uninterrupted, error-free, or completely secure. You assume all responsibility for the selection and use of the software.
Limitation of Liability
IN NO EVENT SHALL PICTUSCODE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability shall not exceed the amount you paid for the software or service in question.
Termination
This Agreement is effective until terminated. We may terminate your license immediately if you fail to comply with any term of this Agreement.
Upon termination, you must cease all use of the software and destroy all copies in your possession.
Support and Maintenance
Support and maintenance services are provided as specified in your service agreement. Standard support includes:
- Bug fixes for 30 days from delivery
- Email support during business hours
- Documentation and user guides
Extended support and maintenance packages are available for purchase separately.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising from this Agreement shall be resolved in the courts of Tamil Nadu, India.
